The firm was representing a man suing Avianca Airlines. One of the firm’s attorneys used ChatGPT to write a brief, having mistaken it for a search engine. The program generated false cases for the attorney to use, which led to questions by the court.
This incident highlights one huge problem of using AI software (such as ChatGPT) – is it ethical to even use them? This is a question that is being passed through the New York Federal Court right now as a result of the lawsuit.
The judge ordered the attorneys responsible to appear for a hearing in court to argue against facing sanctions by the court.
